Context
Medecins Sans Frontieres (MSF) is an international independent medical and humanitarian action-driven organization that offers assistance to populations in distress, to victims of natural or man-made disasters and to victims of armed conflict, without discrimination and irrespective of race, religion, creed or political affiliation. The MSF movement is built around 5 operational centers (OC) supported by 23 sections and offices worldwide. MSF in Greece provides humanitarian and medical assistance to the refugee and migrant populations fleeing conflict in their home countries.
Main Purpose
Ensure the provision of legal advice and support for MSF patients in OCG clinic, Samos island. Engages in direct support for the patients within the admission criteria set and according to MSF values, standards and procedures in order to facilitate vital complementary support provision for those highly in need.
Accountabilities
Provide legal counselling, guidance and support (escorts, representations to Greek Authorities) to all patients requiring legal servises, according to the admission criteria as described in the context specific section below.
Liaise with relevant actors, protection and legal NGO, and lawyers on specific asylum claims.
Participate and represent MSF in working groups and meetings.
Infrom and brief all project staff on legal issues in regards to the target population.
Participate in project sitrep with all relevant legal information (cases, trends, indicators etc).
Advise on MSF medico-legal protocols and tools, notably regarding medical certificates, and transfer of personal information to third parties (see med-legal toolbox) in terms on their compliance the relevant Greek legislation.
Provide advice and support in the management of complex cases of SV (issues linked to medical confidentiality, reporting, protection).
Provide advice and support in the management of complex cases of minors and specificallyunaccompanied minors (issues linked to protection, medical confidentiality, legal path…).
Provide an analysis of the legal enviroment influencing the access to health care and the asylum process, detention, sexual violence, EU/Turkey deal, Dublin 4 and other topics of interest for the patients and the concerned population in Greece.
Assist in the draft of written proposals related to advocacy.
Assist to the drafting of directions to the TMS beneficiaries.
Work closely with Samos social worker and the HAO.
The Legal Officer is engaged to the patients of clinic direct social support and medical aid issues.
The Legal Officer is engaged in the Project Coordination Support and portfolios of Advocacy.
The Legal Officer will be part of Social Services provided in Samos project.
Admission criteria in order to provide counselling, guidance, as defined by the Project Coordination.
Qualifications
Minimum 3 years as Lawyer in the Migration and Refugee portfolio.
Minimum of 1 year case management experience of legal cases of refugees within Greece over the last 2 years.
Full Knowledge of the Asylum Process, experience as Lawyer of the second degree support -management of asylum claims.
Experience in cooperation with other relevant specialties like Social Workers, Psychologists or Doctors.
French Language, English language is mandatory.
Desirable computer literacy (word, excel and internet).
